Chancery Court
 
Chancery Courts have jurisdiction of disputes in matters involving equity, domestic matters, including adoptions, custody disputes, and divorces; guardianships; sanity hearings; wills and any challenges as to the constitutionality of state laws. Additionally, land record disputes are filed and settled in the Chancery Court.
 
Chancery Courts have jurisdiction over juvenile matters in counties which have no County Court. Clay County has a Youth Court which is presided over by Judge Thomas B. Storey, Jr, Special Master appointed by the Senior Chancery Judge of the 14th Chancery District.
 
Clay County is part of the 14th Chancery Court District. Other Counties that are part of the 14th Chancery District are: Chickasaw, Lowndes, Noxubee, Oktibbeha, and Webster Counties.   The Judges which preside over the 14th Chancery Court District are:

 Youth Court
 
The County Youth Court is an extension of the Chancery Court System. Chancery Courts have jurisdiction over juvenile matters in counties in which have no County Youth Court. However, the Senior Chancellor may appoint a lawyer in private practice to sit as a Youth Court Referee to hear matters involving juveniles. Clay County’s Youth Court Referre is, Thomas B. Storey, Jr., of Edwards, Storey, Marshall, Helveston, & Easterling, LLP. Judge Storey has served as the Youth Court Judge for 38 years in Clay County. 
 
Youth Courts deal with matters involving the abuse and neglect of juveniles and offenses committed by juveniles. A juvenile who has not reached the aged of 18 may be subject to the Youth Court System.

Financial InformationCounty Treasurer, County Auditor, and Comptroller

Section 19-17-1, Mississippi Code 1972, charges the Chancery Clerk with the responsibility of County Auditor. Section 27-105-343, Mississippi Code 1972, charges the Chancery Clerk with the responsibility of County Treasurer. Serving in these capacities, I strive to ensure your tax dollars are safe guarded and wisely spent. As Chancery Clerk, I take seriously all of my duties and responsibilities; however, when it comes to handling the county finances and treasury, I do not take this duty lightly. The County treasury is the present and future for Clay County. Without proper supervision and internal controls in place over the treasury, this could have a negative impact on the future of the county. Therefore, it is imperative to me our tax dollars are accounted for and monitored. Each month the county’s Comptroller, LaFrance Boyd, the Board, and I examine and monitor the County’s financial position and the cash balances in every fund.   You can rest assured the county is in a sound financial position.

Land Records
 
 

Land records refer to those record series that may involve real estate.  These include documents traditionally recorded in Deeds Books and Plat Cabinets, such as Deeds, Deed of Trust, Authorities to Cancel, Plats, Name Change Orders, and many other documents.  The Land Records Division also includes dockets and indexes of judgments and certain Uniform Commercial Code transaction files that are recorded as liens on real estate.

All land records are available for public inspection from 8:00 a.m. to 5:00 p.m., Monday thru Friday.  Fees for copies made by the public are $ .25 per page.  The fee for copies made by our staff is $ .50 per page.  There is an additional fee for certifying a copy of a document.  Listed below is the Filing Fee Schedule of all filing fees associated with filing an instrument in the Chancery Clerk’s office.

Requests for copies sent by mail must be accompanied by check or money order covering the cost of the copies and a stamped self-addressed envelope.  The request should reasonably identify the document to be copied; specifically, the book and page number in which the document is recorded. 

There are different recording requirements depending on the type of document being filed in the Chancery Clerk’s office.  We are unable to list all the recording requirements here; however, it is the responsibility of the person offering the document for recording to make sure (1) the document is an original, (2) the document is signed and that all signatures are properly acknowledged before a notary public, (3) the document is a complete writing and contains the required information, and (4) the document is accompanied by the proper fees.

The Chancery Clerk’s staff cannot give legal advice.  Those seeking legal advice to record a document in the Chancery Clerk’s office are encouraged to obtain the advice of legal counsel.

The Chancery Clerk’s office accepts (1) cash and (2) checks or money orders made payable to the Clay County Chancery Clerk.

 Passports

As a service to the citizens of Clay County and surrounding areas, the Clay County Chancery Clerk’s office is proud to serve as a Passport Acceptance Agent in cooperation with the U. S. Department of State.

Applications

Passport applications are available in our office located at 205 Court Street in West Point, Mississippi or may be downloaded at http://travel.state.gov.  Please do not sign applications until you arrive in person in our office.  For more information please contact Becky Cox, deputy clerk, at (662) 494-3124.  Additionally, you may also email our office at bcox@claycounty.ms.gov.  Office hours are Monday thru Friday at 8:00 a.m. thru 5:00 p.m.  No appointments needed.

Requirements

In order to submit a proper Passport Application, the following documents must be presented to our office: 

  1. Certified copy of the applicant’s birth certificate, previously issued passport, or certificate of naturalization;
  2. A valid driver’s license or other state issued identification card photo;
  3. Two (2) identical passport photos size 2x2;
  4. The proper fees as set forth below; 

All persons that present out-of-state primary ID, such as a Driver’s License, are also required to present a second ID and submit a front and back photo copy of that second ID with the passport application.

The second ID should contain as much of the following information as possible: the person’s photo, full name, date of birth, and the document issuance date (example:  Employment ID, Student ID, Voter Registration card, etc.)  This information is also available to customers online at http://travel.state.gov.

For children under age 16, both parents or legal guardians must appear in our office in person, and both parents must sign the child’s application in front of a representative of our office.  Additionally, the child must be present, as well.  Both parents must submit a valid Driver’s License, Passport, Military Identification Card, or other state-issued Identification Card.  The child does not sign the application.
